Designation of legal persons for performing metrological verifications of measuring instruments used in the fields of public interest or the designation of legal persons for performing measures in the fields of public interest

Legal entities that perform metrological verification of measuring instruments subject to legal metrological control by metrological verification according to the provisions of the Law on Metrology No. 19/2016 or that perform measurements in areas of public interest according to Article 12 of the respective Law, except for the authorities authorised by law with the right to perform these measurements, are required to obtain the designation from the central metrology authority according to the applicable normative documents before performing these activities.

A certificate is a document issued by the relevant authority in accordance with the law. It certifies the holder's right to perform metrological verification of measuring instruments subject to legal metrological control and/or to carry out measurements in areas of public interest.

    The expertise of the documents

    The submitted documents will be reviewed by the Ministry of Economic Development and Digitisation within 10 days to assess their compliance with the established criteria and to determine the scope of designation. Following an expert review of the submitted documents, the Ministry of Economic Development and Digitization will issue a report on the designation or extension/withdrawal of the scope of designation for metrological verification of measuring instruments subject to legal metrological control/measurement in areas of public interest. The designation or extension/withdrawal of the scope of designation shall be granted on the basis of the assessment carried out by the National Accreditation Centre in accordance with the conditions set out in Law No. 235/2011 on accreditation and conformity assessment activities, as confirmed by the accreditation certificate and its annex.

    Making the decision

    The Ministry of Economic Development and Digitalisation will make the final decision on the designation or extension/withdrawal of the scope of designation, following a recommendation from the National Metrology Council. This will be done within 30 days of the submission of the application with the relevant annexes. Following the positive conclusions of the expert report and the recommendation of the National Metrology Council, the Ministry of Economic Development and Digitization issues the order on designation or extension/withdrawal of the scope of designation and issues the legal entity with the certificate of designation, which includes an annex. In the event of an extension or withdrawal of the scope of designation, an amended annex will be issued in accordance with the approved forms. The certificate of designation will be issued for a period not exceeding the validity period of the accreditation certificate. The issued certificate of designation will be available on the single governmental portal of public services (www.servicii.gov.md). In the event that the Ministry of Economic Development and Digitization declines to designate the legal entity in question, it shall inform the entity in writing of its decision within 30 days of the submission date. The reasons for this refusal shall be clearly stated. The grounds for refusal are as follows:

    1. The inclusion of incorrect information in the application and accompanying documents.

    2. The failure to comply with at least one of the established criteria.
