Individual authorization to import strategic goods

Single permission to import strategic goods into the customs territory of the Republic of Moldova on a permanent or temporary basis, from a natural or legal person in another country, including the transmission of software or technologies by intangible means.

Requirements for the applicant:

to know and comply with the legislation on the control of the trade of strategic goods;
to stay informed about legislative updates and regulations in the field of strategic goods trade control;
to demonstrate integrity, transparency, rigor, and responsibility in communication with the issuing authority;
to ensure that the quantity of strategic goods traded complies with the specifications mentioned in the authorization for the trade of strategic goods;
to respect the validity period specified in the authorization for the trade of strategic goods;
to ensure that the strategic goods traded are delivered exclusively to the end recipient mentioned in the authorization for the trade of strategic goods;
to submit, at the request of the Commission, through the issuing authority, within the established deadlines, the requested documents, data, and information, as well as to grant access to the Secretary of the Commission and/or the representative of the Information and Security Service of the Republic of Moldova and the working group in their premises and any other owned spaces for verifying relevant aspects regarding the conclusion, execution, or completion of operations subject to control under this Regulation and determining whether the strategic goods are subject to the control regime;
to fulfill all special conditions provided in the authorization for the trade of strategic goods;
to ensure the transportation of strategic goods to the destination indicated in the authorization for the trade of strategic goods;
to participate in activities organized by state institutions for information on the application of national legislation and legislative changes in the field.

Step 1. Submitting the application
The applicant or their legal representative submits an application with the necessary documents attached to the Authorization and Certification Section of the Public Services Agency (Chisinau municipality, 42 Puskin Street, bl.G).

Step 2. Examination of the application
The responsible specialist opens the case, examines the application and checks the accompanying documents. In the case of the lack of the necessary documents/information expressly provided for by the legislation, the specialist will suspend the deadline for examining the application and will immediately inform the applicant of this fact, specifying and describing the reason for the suspension, the deadline and the remedial action to be taken.
The application, with the complete set of documents, shall be submitted to the National Commission for Controlling the Trade of Strategic Goods for taking the decision on issuing or refusing the authorization.

Step 3. Release of the Authorization
In accordance with the Commission's decisions (recorded in the Minutes of the Commission meeting), the Public Services Agency will issue or deny the issuance of the authorization and notify the applicant of the decision taken within 10 working days from the adoption of the decision by the Commission.
The applicant or their legal representative will collect the permit document at the application submission counter.

Profile of the foreign partner (identification data and field of activity), in the situation where it appears for the first time in a commercial relationship with the applicant
Documents submitted as copies to the licensing authority must be accompanied by original versions, which will be returned to the applicant after verification
During the process of examining the application for the issuance of the authorization for the trade of strategic goods, the issuing authority has the right, if necessary, to request from the applicant additional information and documents related to the submitted application. The applicant for the authorization for the trade of strategic goods has the right to submit additional information and documents to facilitate the process of examining the application for the issuance of the mentioned authorization.
The registration certificate of the applicant authorized to engage in the trade of strategic goods
For the temporary import of strategic goods included in the lists of strategic goods subject to control, for participation in tests, demonstrations, exhibitions, or trade fairs, the issuance of an individual authorization is required. The following documents shall be attached to the application for the individual authorization:
• the registration certificate of the applicant authorized to engage in the trade of strategic goods; • end-user statement, completed according to the standard form; • justifying document of the temporary import operation (contract, order, request, invitation, agreement, etc.); • the name and full contact details (address, phone, fax, e-mail) of other persons involved in the operation (if applicable: payers, intermediaries, agents, etc.). If no other persons are involved in the import operation, the applicant must submit a statement acknowledging this fact. The return of products temporarily imported for tests, demonstrations, exhibitions, or trade fairs is done based on the same authorization.
To obtain the individual authorization for trading nuclear and radioactive substances included in the lists of strategic goods subject to control, as well as their systems, equipment, and accessories (category 0 of the Dual-Use Goods List, chemical-radioactive elements, radioisotopes and compounds, mixtures, and residues containing these substances, included in group C of category 1 of the Dual-Use Goods List), the applicant shall submit an application to the issuing authority, to which they will additionally attach, depending on the operations performed, the following documents:
copies of radiological authorizations, authorizations that grant the applicant the right to transport nuclear substances, radioactive substances, and their systems, equipment, and accessories, which can generate ionizing radiation fields.
Commercial documents related to the import operation, concluded with the end-user, if applicable
Commercial documents related to the transaction concluded with the foreign partner and, if applicable, documents proving the total value specified in the authorization request, submitted as copies
The copy legalized by the economic agent of the authorization certifying the permission of the foreign company to trade strategic goods, issued by the competent authority of the country where the said company is registered, which shall contain data similar to those in the authorization application
For the temporary import of strategic goods included in the lists of strategic goods subject to control, the issuance of an individual authorization is required. The following documents shall be attached to the application for the individual authorization:
• the registration certificate of the applicant authorized to engage in the trade of strategic goods; • end-user statement, completed according to the standard form; • documents regarding the qualitative and technical characteristics of the goods; • commercial documents related to the temporary import operation of strategic goods; • the copy legalized by the economic agent of the authorization certifying the permission of the foreign company to trade strategic goods, issued by the competent authority of the country where the said company is registered, which shall contain data similar to those in the authorization application. The return of products temporarily imported for tests, demonstrations, exhibitions, or trade fairs is done based on the same authorization.
Documents drafted in other languages, attached to the application for the issuance of the authorization for trade in strategic goods and related documents, must be accompanied by their translation into Romanian
Self-assessment sheet regarding the categories of strategic goods according to the lists of strategic goods subject to control, which shall include, in particular, the codes used for the authorization request
End-user statement, completed according to the standard form
Documents regarding the qualitative and technical characteristics of the goods
Confirmation of power of attorney, as applicable (proxy/MPower power of attorney)
The name and full contact details (address, phone, fax, e-mail) of other persons involved in the operation (if applicable: payers, intermediaries, agents, etc.).
If no other persons are involved in the import operation, the applicant must submit a statement acknowledging this fact
