Wholesale and Retail License for Importing and Selling Gasoline, Diesel, and/or Liquefied Gas at Filling Stations

A permissive act issued by the competent authority, in accordance with the law, which certifies the holder's right to import and wholesale or retail gasoline, diesel, and/or liquefied gas at filling stations.

Step 1. Submission of the Application
Application submission is done online by accessing the “Request” button:
1.     The applicant (or their legal representative) logs into the system (Public Services Electronic Portal) either personally or with the help of the counter receptionist.
2.     The applicant (or their legal representative) completes the application and uploads the required documents, either personally or with the assistance of the counter receptionist.
3.     If the applicant (or their legal representative):
a) Submits the application and necessary documents with the help of the counter receptionist: The receptionist will receive and properly register the license application and collect the documents presented by the applicant. The receptionist will immediately and unconditionally issue the applicant a certificate of receipt according to the model specified in Annex No. 3 to Law No. 160 of 22.07.2011. The receptionist will send the case (electronic copies of the application and the documents presented) to the issuing authority for review. The application can only be returned to the applicant if it does not contain the necessary information for the identification of the applicant.
b) Submits the application and uploads the documents directly into the system: The system will automatically generate an electronic document confirming the receipt of the application and documents (“certificate of receipt”). The system will automatically direct the application and set of documents to the issuing authority.

Step 2. Payment of the fee
Upon approval of the issuance of the permissive act, the applicant or their legal representative shall receive an electronic notification and shall pay the prescribed fee through the MPay service or at a bank.

Step 3. Issuance of the License
1. When the permit (letter) is ready, the applicant (or their legal representative) receives an electronic notification, downloads the permit, and confirms the receipt of the document.
2. If the permit is issued on paper (upon request or according to the requirements of the issuing authority), the receptionist/specialist prints the permit, delivers it to the applicant (or their legal representative), and confirms the receipt.

• Documents Confirming Qualified Personnel Documents confirming that the applicant has qualified personnel for carrying out the activity for which the license is requested (Article 15, Paragraph (2) of Law No. 461/30.07.2001).
• Financial Statements or Bank Account Statement Financial statements for the most recent period or a bank account statement for business initiation (Article 15, Paragraph (2) of Law No. 461/30.07.2001).
• Documents Confirming Storage Facilities Documents confirming that the applicant owns or leases petroleum storage facilities for gasoline and diesel with a minimum volume of 1,000 m³, or that liquefied gas importers have their own or leased storage facilities for liquefied gas with a minimum volume of 150 m³ (Article 14, Paragraph 1, Letters a) and b) of Law No. 461/30.07.2001).
• Application for License Issuance/Amendment The application/request for the issuance/amendment of the license for the type of activity in the petroleum products market.
• Cash Register and Meter Calibration Certificate Cash register card and metrological certification (Article 26, Paragraph (5) of Law No. 461/30.07.2001).
• Certified Gas Station Certificate Document confirming that the applicant has a certified gas station for the sale of petroleum products (Article 14, Paragraph (2) of Law No. 461/30.07.2001).
• Lease Agreement Copy A copy of the lease agreement (for leased petroleum storage facilities).
• Registration Confirmation in the State Register of Industrial Objectives Confirmation of registration in the State Register of Industrial Objectives and Potentially Dangerous Technical Installations (Article 5 of Law No. 151/09.06.2022 and Article 14, Paragraph (4) of Law No. 461/30.07.2001).
• Extract from the State Register of Legal Entities Extract from the State Register of Legal Entities issued no more than 10 days before the submission of the application to ANRE for the license issuance/extension.
• Environmental Expertise Opinion for the Gas Station Project Environmental expertise opinion for the gas station project (Article 21 of Law No. 461/30.07.2001).
• Copy of Registration Decision/Certificate for Legal Entity Copy of the Decision/Certificate regarding the registration of the legal entity (Article 11, Paragraph (3) of Law No. 220 of 19.10.2007 on the Registration of Legal Entities and Individual Entrepreneurs).

Article 11. Revocation of the Permissive Act

(1) The grounds for taking legal actions to revoke the permissive act without referring to the court are: a) The request of the permissive act holder for the revocation of the act; b) The decision to deregister the holder of the permissive act from the State Register of Legal Entities and the Register of Individual Entrepreneurs; c) The discovery of false information in the documents submitted to the issuing authority; d) The determination that the permissive act or a copy of it has been transferred to another person to carry out the respective type of activity; e) The failure to rectify, within the legally established period, the circumstances that led to the suspension of the permissive act's validity;

(11) Revocation of the permissive act in other cases than those provided in paragraph (1) of this Article is done in accordance with the provisions of Law No. 235/2006 on the Basic Principles of Entrepreneurial Activity Regulation.

(2) The permissive act is also revoked in other cases expressly provided by the law regulating the respective type of activity.

(3) The date and number of the decision to revoke the permissive act shall be recorded in the Register of Permissive Acts no later than the working day immediately following the day the decision was issued.

(4) In the case of revocation of the permissive act, the issuance fee for the act, if provided by law, is not refunded.

(5) In the case of revocation of the permissive act on the grounds specified in paragraph (1)(c), the sanction provided in Article 263, paragraph (8) of the Contravention Code shall apply, according to legal procedures.

(6) The holder of the permissive act is obliged to submit the revoked permissive act to the issuing authority within 10 working days from the date of communication of the revocation decision. Failure to comply with this requirement is sanctioned in accordance with Article 541 of the Contravention Code.

(7) Revocation of the permissive act during state control or as a result of it is carried out in accordance with the provisions of Law No. 131/2012 on State Control over Entrepreneurial Activity.

(8) For initiating the procedure for the revocation of the permissive act in cases other than those established in paragraph (1) of this Article, issuing authorities that do not have control and/or contravention inspector functions, for determining non-compliance with the legal requirements and conditions by the holder of the permissive act, and when on-site verification is necessary for validating and determining non-compliance, shall request and use documents issued by the control body and/or the contravention inspector with relevant duties, in accordance with Article 11¹.
