Establishing the work capacity loss percentage as a result of a work accident or occupational disease

The determination of work capacity loss percentage resulting from work-related accidents or occupational diseases is carried out by the National Council for Determining Disability and Work Capacity, a public institution under the Ministry of Labor and Social Protection, the only authority empowered with functions in the disability determination field.

    Step 1. Submission of Application and File

    To initiate the process of determining the disability degree, the individual must submit an application and a complete set of documents to the territorial structure of the National Council for the Determination of Disability and Work Capacity. The medical institution initiates the procedure by filling out the referral form (Form F-088/e) in the Automated Information System "Primary Medical Care" or "Hospital Medical Care". The application is accompanied by a copy of the identity document and, if necessary, copies of educational documents.

    Step 2. Examination of the request and the file

    The case manager of the National Council reviews the file. They collaborate with social and medical experts to analyze the documents. If necessary, the individual may be invited for an additional examination. The Council may request additional documents from medical institutions or other responsible authorities. The final decision is made within 30 working days from the application registration date.

    Step 3. Sending documents issued by the National Council for the Determination of Disability and Work Capabilities

    After the evaluation is completed, the issued documents, such as the disability degree certificate and the individual rehabilitation and social integration program, are registered in the Automated Information System and sent to the applicant by mail, email, or through the citizen's portal. The individual can also request a personal receipt of the documents.

    Step 4. Contestation

    If the individual disagrees with the decision to establish or not establish the disability degree, they can appeal the decision within 30 working days from the date of notification. The appeal is submitted to the territorial structures of the Council or directly to the Council. Another case manager will re-examine the file, and in case of disagreements, the file is forwarded to the control service for a final decision.
