Explanatory certificate

The service of issuing an explanatory certificate belongs to the category of services for issuing civil status documents, the purpose of which is to confirm or deny the authenticity of civil status acts or documents, as well as to explain the manner, conditions and other aspects of the registration of civil status acts and facts.

The explanatory (civil status) certificate is issued based on the application:

the holder of the civil status act;
the first- to second-degree relatives (proof of the degree of kinship is provided by civil status acts or documents);
the legal representative of a person whose capacity is limited or in respect of whom a court has ordered a legal guardianship measure (guardian or curator);
the representative authorized by a notarized power of attorney in the name of the natural person, or by a power of attorney based on a signature by electronic signature, recorded in the Register of Powers of Representation by electronic signature (MPower).

Step 1. Submitting the application
Solictarea poate fi depusă:
- online, accesând butonul Solicită (dacă solicitantul deține semnătura electronică)
- la Direcţia audienţă şi eliberarea documentelor de stare civilă a Departamentului stare civilă (mun. Chişinău, str. M.Viteazul 11/1, et. 2)
- la Serviciul stare civilă din raza de domiciliu a solicitantului, inclusiv din cadrul centrului multifuncţional al Agenţiei Servicii Publice
- la Misiunile diplomatice sau Oficiile consulare ale Republicii Moldova acreditate în străinătate (MDOC)
- la Centrele unificate de prestare a serviciilor publice (CUPS) din cadrul Autorităţilor publice locale

Payment of the tariff for the requested service through the Government Electronic Payment Service MPay.

Step 3. Issuance of the document
Dacă solicitarea a fost depusă online, Certificatul electronic va fi disponibil în cabinetul personal al titularului actului (MCabinet).
Solicitanților, care nu sunt beneficiari efectivi, documentul se eliberează imprimat pe suport de hârtie (A4).
Certificatul explicativ, imprimat pe suport de hârtie poate fi ridicat:
- la subdiviziunea de stare civilă sau la misiunea diplomatică, la care a fost depusă cererea de eliberare a certificatului;
- la subdiviziunea de stare civilă, indicată de solicitant în cerere;
- la adresa indicată de solicitant în cerere (în țară sau peste hotare), prin MDelivery

In accordance with the provisions of point 1, section 1 of Annex no. 3 to Government Decision no. 966/2020 on the services provided by the Public Services Agency, the service is provided free of charge to the following categories of persons, citizens of the Republic of Moldova:
1. persons with severe, accentuated or moderate disability;
2. persons who, according to the normative framework, have the status of war veteran;
3. pensioners receiving old-age pensions under Law no. 156 /1998 on the public pension system;
4. participants in the liquidation of the consequences of the Chernobyl accident;
5. victims of trafficking in human beings, on the basis of the approach issued by the Ministry of Health, Labour and Social Protection or by the territorial social assistance structures or by the Ministry of Internal Affairs;
6. persons who are in the care of the state, placed in a residential placement service or in a specialized medical and sanitary social institution;
7. children left without parental care and children temporarily left without parental care;
8. major persons up to the age of 25 who do not have an identity card and who, at the age of 18, had the status of children left without parental care, in order to obtain a birth certificate transcribed in their own name.
The application for provision of the explanatory certificate (from civil status) free of charge shall be examined within the maximum time limit set for the provision of this service.

On the day of

Civil status papers proving kinship
as the case may be, where the document is requested by first- or second-degree relatives
Civil-status documents, where appropriate, which are the basis for explaining the authenticity or other situations relating to the drawing up of civil-status acts
The legal act concluded in authentic form confirming the establishment of the guardianship or curatorship (e.g. the territorial guardianship authority's order, the final and irrevocable court judgment on the establishment of the legal protection measure or, where applicable, the decision of the family council on the appointment of the guardian)
in the case of a person subject to a legal protection measure in the form of guardianship, the appropriate legal representative (curator, guardian)
Confirmation of power of attorney, as applicable (proxy/MPower power of attorney)

Note
The submission of civil status papers is not obligatory if the information on civil status papers and documents is recorded in the archival fonds of civil status registers held by the Public Services Agency; Civil status documents of the citizens of the Republic of Moldova drawn up by the competent bodies of foreign countries after 17.08.2001 have probative value in the Republic of Moldova only if they are transcribed in the civil status registers of the Republic of Moldova. If the civil status facts have been produced and registered in the localities on the left bank of the Dniester and the municipality of Bender, they are to be certified by the issue of civil status papers by the competent civil status authorities of the Republic of Moldova. The service is provided in accordance with the tariffs established in accordance with the legal provisions, depending on the term of the order, which are paid by the applicant. Beneficiaries of facilitations, in accordance with the legal provisions, are fully exempted from payment for the services rendered upon presentation of the confirming documents.
