Certificate of marriage capacity

Certificate of marriage capacity is a civil status document confirming the right of a citizen of the Republic of Moldova to conclude a marriage in accordance with the normative framework of the Republic of Moldova (expressing proof of the absence of impediments to marriage). The document is issued on the basis of a statement, on the basis of civil status records and is intended for use in the States forming the territorial scope of the ICCS Convention No. 20 on the issue of marriage capacity certificates signed in Munich on September 5, 1980: Germany, Belgium, Spain, Greece, Italy, Luxembourg, Netherlands, Portugal, Switzerland, Turkey, Republic of Moldova. The document issued on the basis of the ICCS Convention No. 20/1980 does not require supralegalization/apostillation or translation). 

Certificate of marriage capacity is issued on the basis of the applicant's request: 

  • natural person, citizen of the Republic of Moldova;
  • the first- to second-degree relatives (proof of the degree of kinship is provided by civil status documents or civil status certificates);
  • the legal representative of a person whose capacity is limited or in respect of whom a court has ordered a legal guardianship measure (guardian or curator);
  • the representative authorized by notarized power of attorney or by electronic power of attorney granted through MPower on the basis of electronic signature, on behalf of the natural person, citizen of the Republic of Moldova. 

The certificate of marital capacity is valid for 6 months after issue. 

Attention! Documents issued by the authorities of States which are not party to the Hague Convention of October 5, 1961 on the Abolition of the Requirement of Supreme Authentication for Foreign Official Documents (e.g. Jordan, Canada, Kuwait, Lebanon, Libya, United Arab Emirates, Syria, etc.) intended for use in the territory of the Republic of Moldova or which have objected to the accession of the Republic of Moldova to the Convention (e.g. Germany), shall be subject to the procedure of supralegalization. 

They produce legal effects on the territory of the Republic of Moldova without the need for supralegalization/apostillation: 

  • multilingual extracts from birth, marriage and death certificates issued pursuant to the Convention of the International Commission on Civil Status No. 16 of 08.09.1976, Vienna, concerning the issue of multilingual extracts from civil status records by the competent authorities of the following foreign States: Germany, Austria, Belgium, Spain, France, Italy, Luxembourg, Netherlands, Portugal, Switzerland, Turkey, Slovenia, Croatia, North Macedonia, Bosnia and Herzegovina, Serbia, Poland, Montenegro, Moldova, Lithuania, Estonia, Romania, Bulgaria, Cabo Verde;
  • documents of the Member States of the Commonwealth of Independent States;
  • documents of the States with which the Republic of Moldova has concluded bilateral treaties, including by succession: Latvia, Lithuania, Romania, Czech Republic, Slovak Republic, Republic of Hungary.

    Step 1. Submitting the application

    The application shall be submitted in the following ways: 

    1) online - by clicking the Apply button. The online service is accessible for persons with electronic or mobile signature. Delivery to the requested address is available through the government delivery service MDelivery;

    2) at the Civil Status Department's Civil Status Documents Issuing and Attendance Department (Chisinau mun,, 11/1 M. Viteazul str., 2nd floor); 

    3) at the diplomatic missions or consular offices of the Republic of Moldova accredited abroad (DMCO).

     Payment of the tariff for the requested service through the Government Electronic Payment Service MPay.

    1) the Civil Status Department's Civil Status Documents Issuing and Audience Department (Chisinau mun., 11/1 M. Viteazul str., 2nd floor); 

    2) diplomatic missions or consular offices (DMCO) of the RM; 

    3) delivery to the requested address through the government delivery service MDelivery.
