Registration of the geographical indication, the appellation of origin, the traditional specialty guaranteed

The geographical name of a region or a locality, a specific place (e.g. CODRU, Stefan Voda), used to designate a product originating in that region, locality, specific place may be registered as a geographical indication (hereinafter - GI), appellation of origin (hereinafter - AO).

Only an agricultural product or foodstuff that is produced using traditional raw materials or is characterized by a traditional composition or by a mode of production and/or processing reflecting a traditional type of production and/or processing may be registered as a traditional specialty guaranteed (hereinafter - TSG).

Only a group shall be entitled to apply registration of an AO, a GI, or a TSG (a natural person or legal entity, or a competent authority may be treated as a group).

- Natural or legal persons having their residence or main headquarter, or a real and effective industrial or commercial enterprise in the Republic of Moldova shall act before AGEPI personally or through a representative empowered by a power of attorney. 

- Natural or legal persons having neither their residence, nor main headquarter, nor a real and effective industrial or commercial enterprise in the Republic of Moldova shall be represented before AGEPI in any procedure established by this Law by an authorized attorney empowered by a power of attorney.

    Step 1. Filing of the application

    Application filing methods:

    - with the Agency counter at the address: 24/1, Andrei Doga Str., MD-2024, Chisinau, Republic of Moldova;

    -   online, by accessing the link (https://e-servicii.agepi.gov.md/);

    -   by e-mail, cerere@agepi.gov.md, (the application shall be deemed filed on the date of receipt of the e-mail, if AGEPI receives the original application within one month from the date of receipt of the e-mail, except for the electronic document signed with digital signature).

    Step 2. Payment of the service

    Step 3. Processing and Examination

    Following the receipt of the application, where appropriate, the AO, the GI or the TSG, compliance with the filing date awarding requirements shall be examined, including the examination of the other application filing requirements, where appropriate, the AO, the GI or the TSG. If following the examination of the compliance with the application filing requirements, where appropriate, the AO, the GI or the TSG, it is revealed that the application complies with the requirements of Law No. 66/2008 on the Protection of Geographical Indications, Appellations of Origin and Traditional Specialties Guaranteed (hereinafter - Law No. 66/2008) and the Regulations on the Procedure for Filing, Examination and Registration of Geographical Indications, Appellations of Origin and Traditional Specialties Guaranteed, the application data, where appropriate, the AO, the GI or the TSG shall be published in BOPI.

    If the application, where appropriate, the AO, the GI or the TSG does not meet the filing requirements, a decision shall be issued by which the application is deemed not to have been filed or withdrawn.

    The substantive examination shall include:

    a) examination of third-party oppositions, if applicable;

    b) examination of the grounds for refusal specified in Art. 7 of Law No. 66/2008.

    Where, during the substantive examination, it is found that name requested may not be registered, AGEPI shall issue a notice of provisional refusal of registration, where appropriate, of the AO, the GI or the TSG and grant a 2-month period from the date of receipt of the notice with a view to withdra or amend the application or submit an appeal to the notice of provisional refusal.

    Depending on the findings of the examination, AGEPI shall adopt one of the following decisions:

    1. to fully or partially register, as appropriate, the AO, the GI or the TSG, or

    2. to reject the application for the registration, as appropriate, of the AO, the GI or the TSG.

    Step 4. Registration, where appropriate, of an AO, a GI or a TSG/withdrawal of the application for the registration, as appropriate, of an AO, a GI or a TSG

    In the case of issuing a decision to register, where appropriate, an AO, a GI or a TSG in whole or in part, and in the case of complying with the requirements for registration, where appropriate, of an AO, a GI or a TSG, the trademark shall be registered, provided that the registration fee, where appropriate, for AO, GI or TSG has been paid within the established term.

    If the application, where appropriate, the AO, the GI or the TSG does not comply with the requirements for registration, where appropriate, of an AO, the GI or the TSG, a decision shall be issued to withdraw the application, where appropriate, the AO, the GI or the TSG.

    Note: Any decision on the applications for the registration, where appropriate, of the AO, the GI or the TSG, may be appealed by the parties within 2 months from the date of its receipt or by the third parties holding information related to the registration concerned - within the period between the date of issuance of the decision and the date of the registration thereof.
