Renewal of the validity of the trademark registration certificate

Trademark registration shall grant the owner the exclusive right to dispose of the trademark, to use it, as well as the right to prohibit other persons from using it on the territory of the Republic of Moldova for the entire period of validity of the trademark.

Registration of a trademark may be renewed for 10 consecutive years whenever necessary, namely during 6 months after the expiry of the trademark right.

Renewal of the validity of the trademark registration certificate may be requested by the owner or any other person expressly authorized thereby by filing an application for renewal of trademark registration (hereinafter - application) to AGEPI.

- Natural persons and legal entities which have their place of residence, respectively, main place of business in the Republic of Moldova, entitled to obtain the legal protection of a trademark, shall act before AGEPI personally or through a representative, empowered by a power of attorney.

- Natural persons and legal entities which have their permanent place of residence, respectively, main place of business y abroad shall act before AGEPI only through an authorized attorney from the Republic of Moldova.

- Where a foreign legal entity is affiliated with a legal entity which has its place of residence in the Republic of Moldova, the first may act before AGEPI through its affiliated person or its representative, empowered by a power of attorney.

    Step 1. Filing of the application

    Application filing methods:

    - at the Agency counter at the address: 24/1, Andrei Doga Str., MD-2024, Chisinau, Republic of Moldova;

    - online, by accessing the link (https://e-servicii.agepi.gov.md/);

    by e-mail, cerere@agepi.gov.md, (the application shall be deemed filed on the date of receipt of the e-mail, if AGEPI receives the original application within one month from the date of receipt of the e-mail, except for the electronic document signed with digital signature).

    Step 3. Processing and Examination

    Following the receipt of the application for renewal of trademark registration, the fulfillment of the legal requirements for the renewal of a trademark shall be verified, namely, the correctness of the payment of the fee for renewal of trademark registration (within the established amount and terms); the owner’s identification data; the address for correspondence; the list of goods and/or services requested (registration is renewed only for the goods and/or services for which the trademark was registered or is requested for a narrower list of goods and/or services for which the trademark was registered); where appropriate, the powers of the representative; where appropriate, permission to use the official or historical name of the state; where appropriate, permission to use the name of the administrative-territorial unit “Chisinau”.

    Depending on the substantive examination results, AGEPI shall take one of the following decisions:

    1. concerning the full or partial registration of ae trademark; or

    2. on refusal of the trademark registration application.

    Step 4. Issuance of the renewed trademark registration certificate / refusal of the application for renewal of trademark registration

    In the case of issuing the decision to renew the trademark registration, the renewed trademark registration certificate shall be issued in the name of the owner, or his representative, with the same trademark registration number, preceded by the inscription R or, as appropriate, 2R, 3R, etc., depending on the order number of the renewed term.

    In case of non-fulfillment of the requirements for the renewal of trademark registration, a decision shall be issued to rejfuse the application for renewal of trademark registration, which may be appealed to the Appeals Board of AGEPI within two months from the date of its receipt.

    In case of failure to file the application for renewal of trademark registration, after the additional period of 6 months that begins to run the second day after the expiry of the established term, it shall be established that the trademark registration term has expired from the day following the date on which the trademark registration expires, the data on expiry of the trademark registration shall be entered in the National Register of Trademarks and the information on expiry of the trademark registration shall be published in BOPI.
