Authorization for specialized commercial operations

A document, issued in accordance with the law by the Civil Aviation Authority, attesting the capability and right to perform specialized commercial operations (aerial work), other than commercial air transport, in which the aircraft is used for activities in areas such as agriculture, forestry, construction, photography, surveillance, observation and patrolling, aerial advertising, etc.

Submission of the application
The application can be submitted online, by pressing the "Request" button in the Automated Information System for the management and issuance of permissive documents (AIS MIPD) or at the CAA one-stop shop, located in Chisinau municipality, 80/2 Dacia Blvd.

Processing and examination
Upon receipt of an application for a specialized commercial operations authorization, the CAA shall examine the operator's risk assessment documentation and Standard Operating Procedures, hereinafter - SOP, related to one or more planned operations.
For organisations holding an Air Operator's Certificate, the examination procedure will be carried out in accordance with the provisions of point 2.1 and subpoint 1 point 2.2 of Chapter 2 of Section 1 of the Civil Aviation Procedures and Instructions CAPI - OPS Part SPO (air work) Specific provisions for specialized commercial operations (air work).
For organisations which do not hold an Air Operator Certificate and apply for the initial issue of a specialized commercial operations authorization, the examination procedure will be conducted in accordance with the provisions of points 1.1-1.5 Chapter 1 of Section 2 of the Civil Aviation Procedures and Instructions CAPI - OPS Part SPO (air work) Specific provisions for specialized commercial operations (air work). All stages of authorization are relevant.

Release/refusal of release
For organisations holding an Air Operator's Certificate, the issuance of the authorization for specialized commercial operations is carried out through the government portal AIS MIPD, in compliance with subpoints 4-5, point 2.2 of Chapter 2, Section 1 of CAPI - OPS Part SPO (air work) or at the CAA one-stop shop (Chisinau municipality, 80/2 Dacia Blvd, Air Operations Directorate).
For organisations that do not hold an Air Operator's Certificate, the issue of the authorization for specialized commercial operations is carried out via the AIS MIPD government portal, in compliance with subpoints 5-7, point 1.6 of Chapter 1, Section 2, of the CAPI - OPS Part SPO (air work) or at the CAA one-stop shop (Chisinau municipality, 80/2 Dacia Blvd, Air Operations Directorate).
Refusal to grant the authorization must be notified in writing to the applicant at the electronic address, in compliance with the legal requirements relating to the electronic document.

Documents required in accordance with Annex No. 3 to the Regulation approved by Government Decision No. 612/2022:
ORO.SPO.110 Authorization of specialized commercial operations (a) An organisation intending to conduct specialized commercial operations must apply for and obtain an authorization issued by the CAA before commencing a specialized commercial operation. (b) An organisation intending to conduct specialized commercial operations must provide the CAA with the following information: 1. The organisation's legal name and trading name, address and mailing address (copies of articles of incorporation authenticated by the organisation's stamp); 2. a description of the management system, including the organisational structure; 3. a description of the proposed operation, including the aircraft type(s) and number to be operated; 4. the risk assessment documentation and associated standard operating procedures as required by SPO.OP.230 ; 5. a declaration that all the documentation submitted to the CAA has been checked by the organisation and complies with the applicable requirements; 6. proof of ownership or use (on the basis of a dry lease agreement) of at least one aircraft with a CofA and corresponding to the intended specialized commercial operations; 7. copy of the insurance contract(s) and insurance certificate(s)/policy(ies) for liability insurance for passengers, baggage and cargo, as well as for liability insurance for third parties, in the amounts established by Law No. 118 /2020, as well as the Letter of Undertaking issued by the insurance company/broker or reinsurance company; 8. Information on the contracts concluded between the organisation and the certified agents for the provision of air services certified by the CAA or to be concluded (handling, aeronautical and other airport services), if applicable; 9. a statement that the financial resources necessary for the safe conduct of all operations for which a specialized commercial operations (air work) authorization is applied for can be secured, in accordance with the established form and content requirements. (c) The application for an authorization or for the amendment of an authorization shall be drawn up in the form and manner established by the CAA, in accordance with the provisions of the Air Code and its implementing rules.
